Kilty Property: Review of Phase II Environmental Study
Jeanne Webb, Development Director, noted that subsequent to the Phase I study on the Kilty Property, there were some environmental concerns and the town decided to move forward with a partial Phase II study. Fuss & O’Neill performed both studies, and David Hurley of Fuss & O’Neill was present to initiate a general discussion of the partial Phase II study performed on the property. Any contaminants found on the property were below State standards, except in an area where debris was found, but Mr. Hurley opined that removal of the debris would solve the problem. There would also be some clean-up required in the area of the former garage due to some minor contamination that exceeded State standards, but the clean-up would not be significant. The State would not require clean-up but Fuss &
O’Neill recommends that the clean-up would be minor and should be completed. Fuss & O’Neill also recommended that some further samples be taken and some additional testing be completed. Ms. Webb also noted that this was only a partial Phase II study and that the cost was only $4,500.00 on the ten acre parcel. Mr. Hurley noted that monitoring wells should be placed on the parcel to check ground water. Assistant Corporation Counsel Rich Gentile noted that the Ordinance only requires a Phase I study. Councillor Linda Russo noted that a Phase III study would include ground water sampling. Mr. Hurley noted that the additional samples and testing were not done yet because of the limitations in both scope and cost of the partial Phase II study that was undertaken. Mr. Hurley believes that if the additional samples show results similar to those already performed, and if no ground water impact is found, he believes the Department of
Environmental Protection (DEP) will require only clean-up of the debris area and removal of the contamination in the soil in the area of the former garage, and the property should be cleared by the DEP. Ms. Webb noted that we can apply for CRCOG funds for additional study work, and Attorney Gentile noted perhaps the Town can ask the seller to pay for additional study costs.
Susan Kniep, 50 Olde Roberts Street, asked about “redevelopment” language in the report and Mr. Hurley noted that was a typo and that the property is not being considered for redevelopment but rather only for open space.
